1. The Hickory Dickory Decks (Sponsor) "You Could Win A $10,000.00 Dream Deck" Contest is open to all legal residents of Ontario, Alberta and British Columbia who are 18 years of age or older. The Contest commences on or about February 1, 2008. To be eligible, all entries must be received by August 31, 2008, at 12:00 midnight EST (the "Contest Closing Date"). Officers, directors, representatives and employees of the Sponsor, it’s affiliates, or subsidiaries, and all those living in the same household as the above individuals, are not eligible to enter.
2. To enter the “You Could Win A $10,000.00 Dream Deck” Contest, go to www.hickorydickorydecks.com and complete the on-line entry form. No purchase is necessary. All entries become the property of the Sponsor and shall not be returned. Any entry that is incomplete, inaccurate, irregular in any way, or otherwise not in compliance with the official rules and regulations, is void. Entries are subject to verification and will be declared invalid if they are altered or tampered with in any way. By entering, participants agree to be bound by the contest rules and regulations. This contest is subject to all applicable federal, provincial and municipal laws.
3. There is one (1) Grand Prize to be awarded which consists of a deck designed and installed by the Sponsor. Some conditions may apply and certain designs and models may not work for all installations depending on the size, age and location of the home and property, and subject to relevant provincial and municipal building and zoning laws, by-laws and regulations. Delivery and installation is included and will be arranged with the selected winner. Approximate retail value of the Grand Prize is $10,000.00 CAD (to be determined in the sole discretion of the Sponsor) which value may be applied by the winner to a more expensive Sponsor deck (upon agreement with the Sponsor with such values and costs to be determined in the sole discretion of the Sponsor). The Sponsor reserves the right to also award any such additional prize or prizes (the "Additional Prize(s)") of such value and type as may be determined in the sole discretion of the Sponsor.
4. A random draw for the Grand Prize and Additional Prize(s) will be made on September 1, 2008, (the "Contest Draw Date") from all eligible entries received. The odds of being selected will depend on the total number of eligible entries received. The selected entrant will be notified by mail or telephone. In order to claim the Grand Prize or Additional Prize(s) and be declared a winner, the selected entrant will be required to: (a) answer correctly, without assistance of any kind, a time limited, arithmetical, skill-testing question posed during a telephone interview, in person or by mail; and (b) complete and sign a statement confirming compliance with the rules and regulations; accept the prize as awarded, without substitution (save and except any agreement reached with the Sponsor to apply the Grand Prize value to a more expensive Sponsor deck); release the Sponsor and it’s affiliated companies, advertising and promotional agencies from any liability, as described more fully below; and consent to the use of his or her name, address (city and province), photograph, or likeness, as described more fully below. If a selected entrant cannot be contacted in a timely fashion, or if, for any other reason, the prize cannot be awarded, another contest entry will be randomly selected by draw until the prize has been awarded. Failure of a selected entrant to correctly answer the skill-testing question will result in disqualification, the forfeiture of his or her interest in the Grand Prize or Additional Prize(s) and the random selection of a substitute winner from among all remaining eligible entries. Contact will only be made with the selected entrants.
5. The Grand Prize and Additional Prize(s) must be accepted as awarded, are non-transferable and cannot be exchanged for cash save and except with respect to any agreement reached with the Sponsor to apply the Grand Prize value to a more expensive Sponsor deck.
6. By entering this contest, entrants agree to release, indemnify and hold harmless the Sponsor and it’s affiliates, subsidiaries, advertising and promotional agencies, and their respective directors, officers, employees, agents, heirs, executors, administrators, successors and assigns, from any claim, loss, expense (including legal costs) or other liability that may be sustained in connection with the contest, including, without limitation, any damages resulting from the receipt, ownership, use or misuse of a prize, or while preparing for, participating in, and/or traveling to any prize related activity.
7. Neither the Sponsor nor it’s advertising and promotional agencies assume any responsibility for incomplete, illegible, lost, delayed, destroyed, misidentified or misdirected on-line entries, or entries deemed irregular by the contest Sponsor at its sole discretion, which entries are automatically void.
8. The Sponsor reserves the right to cancel or modify this contest if, at its sole discretion, it determines that for any reason this contest is not capable of running as originally planned, or if fraud or any other occurrence compromises the fairness or integrity of this contest. Without limiting the generality of the foregoing, the Sponsor reserves the right, at it sole discretion, to cancel or suspend this contest should a cause beyond the reasonable control of the Sponsor corrupt the security or proper administration of this contest.
9. If, as a result of an error relating to the entry process, drawing or any other aspect of the contest, there are more potential winners of the prize than contemplated in the contest rules, there will be a random draw amongst all eligible prize claimants after the Contest Closing Date to award the prize.
10. Any attempt to deliberately damage this contest or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
11. The Sponsor shall not be liable to the winner of any prize for any guarantee, warranty, condition or representation, express or implied, relating to the prize, save and except as provided by the Sponsor in the ordinary course of business with respect to the installation of a Sponsor deck.
12. By entering this contest, entrants consent to the use of their name, age, address, photograph or likeness in any publicity related to this contest carried out by the Sponsor, without compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the internet, unless prohibited by law.
